General Terms and Conditions of Contract

SUBJECT

These general conditions regulate the distance contracting of hot air balloon flight services with FRANCESC VIDAL GASCH (hereinafter referred to as VOL AVENTURA), with registered address at c. Puigpardines, 41 – 08560 – Manlleu) (Barcelona), VAT number 33937719-T, telephone number 678603069, email address vineavolar@volaventura.cat.

ACCEPTANCE OF THE GENERAL CONDITIONS

By contracting any of our services, the user expressly declares that they have read, understood, and fully accepted the general conditions of contract, as well as any specific conditions that may be established.

All the general conditions will be permanently available to users prior to contracting and can be stored, reproduced, and printed in the current version at any time.

These conditions will have an indefinite validity period, and VOL AVENTURA reserves the right to unilaterally modify them, without affecting the services or promotions contracted prior to the modification. Therefore, it is advisable to check the current conditions each time you access the website.

The contract will not be archived and will be drafted in the Catalan language.

WHO CAN CONTRACT

In order to contract our services, the contracting user declares and guarantees that they are 18 years old and reside in Spain.

In the case of contracting by a legal entity, the person acting on their behalf declares, under their responsibility, that they have valid powers to contract our services, and VOL AVENTURA reserves the right to verify this.

PRICES AND OTHER EXPENSES

The prices indicated for each type of flight are expressed in Euros (€) and include the services specified on the website for each of them.

CONFIRMATION OF RESERVATIONS

When we receive a reservation request for any of our services, we will proceed to confirm it by email to the address provided, within 24 hours, sending a receipt that will indicate the reservation number and will contain the general and, if applicable, specific conditions of the contract, as well as the bank account number where the deposit or the full price, indicated for each type of flight, must be transferred. In any case, the remaining price must be paid before the flight takes place.

Once the bank transfer is received, we will confirm the reservation by email, which will be valid for one year. The contracted flight must be carried out within this period, and no refund will be made if it is not done due to reasons not attributable to VOL AVENTURA.

To redeem a gift voucher and make a reservation, the participant must contact VOL AVENTURA using the contact details provided on the gift voucher, and the reservation will be confirmed to the email address provided.

The redemption of the gift voucher implies the acceptance of these general conditions by the person redeeming the voucher.

OBLIGATION TO PROVIDE SERVICES AND AVAILABILITY OF SERVICES

The obligation to provide the service is subject to the full payment of the price according to the terms agreed here.

The reservation is valid for one year from the date of confirmation and full payment. If the flight cannot be carried out due to reasons not attributable to VOL AVENTURA, it will be understood that the user waives it, and no refund will be provided.

In the event that, due to major reasons, safety concerns, or atmospheric conditions, the service cannot be provided on the agreed day, we will notify you as soon as possible using the contact information you have provided in order to agree on another day for the activity, which must take place within one year from the date we confirmed the reservation.

For any information regarding the reservation, the user can contact VOL AVENTURA through the contact details provided.

WITHDRAWAL AND CANCELLATION POLICY

The user may exercise their right of withdrawal within 14 calendar days from the date of the reservation, without justification and without incurring any expense, as long as the flight has not been scheduled and the service has not been provided.

To exercise the right of withdrawal, you must notify VOL AVENTURA of your decision to withdraw from the contract through an unequivocal statement by sending an email to the address indicated in these general conditions.

In case of cancellation or withdrawal outside the aforementioned period, the following amounts will be retained:

For cancellations made up to 48 hours before the flight: 50% of the total price.
For cancellations made within 48 hours before the flight: 100% of the total price.

In the event that VOL AVENTURA cancels the flight due to reasons beyond its control, the user may choose between rescheduling the activity or a full refund of the amount paid.

COMPLAINTS AND CLAIMS

Any complaints or claims that the user deems appropriate can be made through the contact details provided. VOL AVENTURA will respond to the complaint or claim within a maximum period of one month from the date of receipt.

In case of any dispute, the parties submit to the jurisdiction and jurisdictional bodies of the user’s domicile.

APPLICABLE LAW AND JURISDICTION

The interpretation and application of these conditions will be governed by Spanish law.

In the event of a conflict, without prejudice to the mandatory provisions of the law, especially when the contracting party is a consumer or user, and waiving any other jurisdiction that may correspond to them, the parties expressly submit to the jurisdiction of the courts of the city of Vic.
